Case Study: Achieving Stability for a Child Through Third-Party Custody

By November 19, 2025No Comments

Background

Our firm was approached by a client seeking custody of her young nephew after the sudden passing of his mother. The child’s biological father had been largely absent from the child’s life and was not providing care or support. The client, who had no children of her own, had stepped in as the child’s primary caregiver, providing a stable and loving home.

Challenges

1. Locating the Adverse Party: The biological father was difficult to locate and refused to provide a current address or participate in the proceedings, requiring creative approaches to service of process, including alternative service methods approved by the court.

2. Establishing Standing: As a third party (the child’s aunt), our client needed to demonstrate her fitness and the necessity of awarding custody to someone other than a biological parent.

3. Best Interests of the Child: The case required clear evidence that remaining with our client was in the child’s best interest, given the lack of involvement from the biological father and absence of other willing family members.

Our Approach

1. Pro Bono Representation: The firm provided representation through a pro bono arrangement, ensuring access to justice regardless of financial means.

2. Persistent Advocacy: We pursued all available legal avenues to serve the adverse party and keep the case moving forward despite obstacles.

3. Comprehensive Evidence: Our team gathered and presented evidence of the client’s role as primary caregiver, the child’s well-being in her care, and the lack of involvement from the biological father.

Outcome

The court granted our client sole legal and physical custody of her nephew. The decision was based on findings that she was a fit and proper person to care for the child, who was thriving in her home. The court recognized that awarding custody to our client was in the child’s best interest, providing him with stability and continuity after a traumatic loss.

Impact

This case highlights our firm’s commitment to protecting vulnerable children and supporting relatives who step up in times of crisis. By navigating complex procedural hurdles and advocating for the best interests of the child, we helped secure a positive future for this family.
